These terms govern the website and the general framework of the service. When a customer subscribes to HotelGEX, the proposal, order, agreement, specific terms, SLA, and data processing agreement shall prevail to the extent that they specifically regulate the relevant matter.
1. Purpose and acceptance
Access to and browsing of hotelgex.es are subject to these terms and the published legal policies. A demo, trial, or subscription may require express acceptance of specific terms before activation.
2. Provider and contact
The service is provided by the entity that owns HotelGEX. Contact: hello@hotelgex.es and Contact. The complete corporate, tax, and registry details must be published in the Legal Notice.
3. Scope of the service
HotelGEX is a modular platform for hotels that may include reservations, guest experience, revenue, operations, customer intelligence, Growth, F&B, groups and events, integrations, and AI. The availability of modules, limits, and integrations shall be those specified in the applicable plan or proposal.
It may operate in No-PMS mode and connect with external providers. An integration shall only be considered available in production once it has been enabled and, where applicable, certified for the specific customer and provider.
4. Free trial
When offered, the standard HotelGEX trial lasts 30 days, unless an offer specifies a different duration. It may limit modules, usage, or capabilities that require credentials, certification, or third parties. A paid subscription requires acceptance of the applicable commercial terms.
5. Pricing, billing, and renewal
Prices, setup fees, billing frequency, taxes, billing commencement, renewal, and cancellation shall be those shown during the subscription process or in the accepted proposal/agreement. A module shall not be deemed purchased unless it is included in the subscription.
6. Customer account and obligations
The customer must provide accurate information, safeguard credentials, manage users and permissions, and use HotelGEX in accordance with the law. The customer is responsible for the instructions issued by its authorized users. If it uploads databases, guest data, prospect data, or third-party content, it represents that it has the necessary legal basis, authorizations, or rights.
7. Artificial Intelligence
AI features may generate analyses, drafts, recommendations, translations, or proposals. Unless a feature is expressly configured and authorized to execute actions, it is intended to assist decision-making. Generative technologies may produce incomplete or inaccurate results; the customer shall apply appropriate human oversight to relevant decisions.
8. Intellectual property
Software, design, trademarks, documentation, interfaces, and proprietary content are protected. The subscription grants a limited, non-exclusive right of use for the duration of the service. The customer retains its rights to its data and content and may not decompile, circumvent controls, exploit vulnerabilities, or resell the service without authorization.
9. Data protection and confidentiality
Processing is governed by the Privacy Policy and, for data processed on behalf of the hotel, by the applicable data processing agreement. Each party shall maintain the confidentiality of the other party’s non-public information.
10. Third parties and integrations
HotelGEX may interoperate with PMS, POS, channel managers, payment providers, email services, infrastructure providers, AI services, and other third parties. Availability may depend on APIs, credentials, contracts, limits, or changes introduced by the provider.
11. Availability and liability
HotelGEX shall adopt reasonable security and continuity measures. Availability, support, recovery, and compensation levels, if any, shall be those set out in the SLA or agreement. Nothing limits liabilities that cannot legally be excluded; in B2B relationships, all other matters shall be governed by the applicable agreement.
12. Suspension and termination
Access may be suspended for security reasons, fraud, abuse, legal obligations, or material breach, in accordance with the applicable communications and contractual measures. Termination and its financial and data-related effects shall be governed by the subscription agreement.
13. Amendments
These terms may be updated due to legal, technical, or service changes. Material changes affecting existing customers shall be managed in accordance with the agreement and applicable law.
14. Governing law and jurisdiction
These terms are governed by Spanish law. In B2B relationships, jurisdiction shall be that agreed by the parties and, in the absence of a valid agreement, the jurisdiction resulting from the applicable procedural rules. This clause does not limit the mandatory rights of anyone who legally qualifies as a consumer.
